Terms and Conditions

This website is owned and operated by South Coast Elements. We may amend these terms and conditions occasionally, and will publish the amended terms and conditions here on the website. This Agreement and use of the website are governed by the laws in existence in Australia, and comply with Australian Consumer Law. You agree that any claim relating to the website, purchases or orders shall be under the jurisdiction of the laws of the State of New South Wales, Australia.

Prices are as advised online, or on an invoice, quoted price or current price list. Prices listed are in Australian (AUD) dollars. South Coast Elements is entitled to adjust prices due to variations in production costs. Unless otherwise advised, our products do not to include delivery costs and exclude GST.

Payment shall be made in full by credit card, PayPal or by direct deposit payment before delivery of the goods. The Customer is not entitled to withhold or withdraw payment due to an account query, dispute or set off unless approved by South Coast Elements. Ownership of goods does not transfer to the Customer until payment is received in full.

Orders are dispatched within 1 to 2 business days from receipt of order, if items are in stock. An order may only be cancelled before 2pm the following day after order. If you wish to cancel an order, a full refund will be issued, minus any transaction and/or other applicable fees incurred by South Coast Elements due to order cancellation. If you should make a mistake when ordering, please contact us immediately and we will endeavour to accommodate your request, however South Coast Elements accepts no liability for incorrectly ordered products.

All deliveries are made to the Customer’s nominated delivery address. South Coast Elements endeavour to fill orders promptly, but will not be liable in respect of any delay occurring in the supply of goods or any consequences of such delay. If stock for an ordered item is unavailable, we may cancel your order (or part of your order) and refund the purchase price to you, or offer you a similar replacement prior to dispatch. If the goods do not correspond with the online description or they are defective, contact South Coast Elements immediately. On arrangement with South Coast Elements, please return goods in the same condition as that in which they were delivered. All orders are subject to availability of stock. South Coast Elements shall at their discretion replace those goods or reimburse the Customer for the price paid for them. Claims must be made within 7 days of the date of delivery. To the extent permitted by law, the Customer agrees that failure to notify South Coast Elements within 7 days of the date of delivery will be deemed acceptance of the goods as satisfactory and the Customer will have no further claim with South Coast Elements.

South Coast Elements is not responsible for damage or loss as a result of the order being undeliverable due to an incorrect address being supplied, or for the inability of the Customer to receive the package on the delivery date.
